Terms of Service
Effective date: 1 January 2025
1. Acceptance of Terms
By accessing or using the Tridimedplatform (“the Platform”), you agree to be bound by these Terms of Service (“Terms”). Access is granted exclusively to authorised personnel of healthcare organisations that have entered into a service agreement with Tridimed.
If you do not agree to these Terms or are not an authorised user, you must not access or use the Platform.
2. Access and Authorisation
Access to the Platform is restricted to staff members explicitly provisioned by an authorised system administrator of a contracted healthcare organisation. Roles include technician, doctor, and administrator.
- You are responsible for maintaining the confidentiality of your credentials.
- You must not share your account or allow unauthorised access.
- You must notify your administrator immediately if you suspect any unauthorised access to your account.
- Tridimed reserves the right to suspend or revoke access at any time for breach of these Terms.
3. Permitted Use
You may use the Platform solely for:
- Managing and reviewing radiology studies and reports within your organisation.
- Uploading, viewing, and annotating medical imaging files for clinical purposes.
- Communicating clinical findings between authorised clinical staff in the context of patient care.
You may not use the Platform to:
- Process data beyond the scope of your role or the service agreement.
- Export, transfer, or disclose patient data to unauthorised parties.
- Reverse-engineer, decompile, or attempt to extract source code or algorithms.
- Perform automated access, scraping, or load testing without written consent.
- Introduce malicious code, viruses, or otherwise attempt to compromise platform security.
4. Health Data and GDPR Compliance
The Platform processes special-category personal data (health data) as defined by Article 9 of the GDPR. As a user and/or data processor:
- You must process patient data only to the extent permitted by your role and your organisation's instructions.
- You must not download or export patient data to personal devices or storage services outside the approved workflow.
- Any suspected personal data breach must be reported to your Data Protection Officer (DPO) and to Tridimed within 24 hours of discovery.
For full details of data processing practices, refer to our Privacy Policy.
5. Intellectual Property
All software, interfaces, algorithms, and documentation comprising the Platform are the exclusive intellectual property of Tridimed or its licensors. No intellectual property rights are transferred to you by these Terms or by use of the Platform.
Clinical data entered into the Platform by your organisation remains the property of the respective patient and/or healthcare organisation, subject to applicable law.
6. Availability and Maintenance
Tridimed aims to provide high platform availability but does not guarantee uninterrupted service. Scheduled maintenance windows will be communicated in advance where possible. Tridimed shall not be liable for any loss arising from temporary unavailability.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Tridimed shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of or inability to use the Platform, including but not limited to loss of data or clinical decisions made on the basis of Platform output.
The Platform is a workflow tool. All clinical decisions remain the sole responsibility of qualified healthcare professionals. Tridimed does not provide medical advice.
8. Termination
Tridimedmay terminate or suspend access immediately, without notice or liability, if you breach any provision of these Terms or if your organisation's service agreement expires or is terminated.
Upon termination, your right to access the Platform ceases immediately. Provisions that by their nature should survive termination (including data retention obligations, intellectual property rights, and limitation of liability) shall so survive.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Tridimed is incorporated, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of that jurisdiction.
10. Changes to These Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted within the Platform and communicated by email to account holders. Continued use of the Platform after the effective date of revised Terms constitutes acceptance.
